Possession of drugs in prison
D was charged with possessing class B and C drugs in prison. It was alleged that drugs were recovered from D’s mattress in his cell whilst he was in prison. The Prosecution alleged that D had placed the drugs within his cell mattress and had full knowledge of the drugs being there.

D denied having any knowledge of the drugs recovered from his mattress and denied placing them there.

The case went to trial whereupon D was acquitted by the Magistrates Court as there was insufficient evidence to prove that he had knowledge of the drugs being within the mattress and due to the inconsistencies in the Prosecution evidence.
